Denied filling out a police report?

My husband was at a bar, he had a few drinks and when he went to leave he got jumped by a group of guys. When the bouncer broke it up he blamed it on my husband and pepper sprayed him! When my husband called the cops they interviewed the bouncer and him seperately and wouldn't let him fill out a police report because he was intoxicated. Can they do that? It just doesn't seem legal to me.
